Terms of Service

1. Acceptance of Terms

By accessing or using the Coastal Mow and Go website (“the Site”) located at coastalmowandgo.co.za or using our services, you agree to be bound by these Terms of Service and Conditions (“Terms”). If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any services provided by Coastal Mow and Go (“we”, “us”, or “our”).

2. Description of Service

Coastal Mow and Go provides professional lawn care, landscaping, and related services in Gansbaai and the Overstrand region. Our Site serves as a platform for you to learn about our services, get quotes, make bookings, and communicate with us.

3. User Conduct

By using our Site or services, you agree not to:

• Violate any laws, regulations, or third-party rights.
• Use the Site for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to any part of the Site, user accounts, or systems connected to the Site.

4. Account Registration

Some features of the Site may require you to register for an account. You agree to:

• Provide accurate, current, and complete information about yourself during registration.
• Maintain the security of your password and accept all risks associated with unauthorized access to your account.

5. Booking and Scheduling

• Appointments: Services are provided by appointment only. You must book an appointment via our website or by contacting us directly.
• Confirmation: Appointments are not confirmed until we send you a confirmation message or email.
• Changes/Cancellations: You must notify us at least 24 hours in advance if you need to reschedule or cancel an appointment. Failure to do so may result in a cancellation fee.

6. Payment Terms

• Fees: Service fees will be quoted at the time of booking based on the scope of work.
• Payment: Payment is due upon completion of the service unless otherwise agreed. We accept EFT payments to our Bank Account or Payment via Card through Paystack a Subsidiary of Stripe.
• Late Payments: Late payments may incur additional fees or interest at the maximum rate allowed by law.

7. Service Terms

• Service Quality: We strive to provide high-quality services. However, we cannot guarantee that every service will meet your exact expectations due to factors like weather or property condition.
• Materials: If we supply materials, they will be charged at cost plus a markup for handling. You can provide your own materials, but we are not responsible for the quality or suitability of such materials.
• Access: You must ensure we have safe and clear access to the property where we will perform services.

8. Intellectual Property

All content on the Site, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is our property or our content suppliers’ property and is protected by South African and international copyright laws. You may not use, copy, modify, or distribute such content without our express permission.

If you post, upload, input, provide, or submit any content on our Site (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, modify, publish, or distribute such content for any purpose related to the operation of the Site or our business.

9. Privacy

10. Liability Limitation

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses. You agree to indemnify, defend, and hold harmless Coastal Mow and Go, its officers, directors, employees, agents, licencors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your account.

12. Customer Responsibilities

• Accurate Information: You must provide accurate information about your property and any specific requirements for the job.
• Hazards: Inform us of any known hazards on your property before services begin.

13. Dispute Resolution

• Negotiation: We aim to resolve any disputes amicably through direct negotiation.
• Jurisdiction: If disputes cannot be resolved, they will be subject to the laws of South Africa, and legal proceedings will take place in the courts of South Africa.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on the Site with the “Effective Date” updated at the top of this page. Your continued use of the Site or services after any changes indicates your acceptance of the new Terms.

15. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Either party may also terminate this agreement at any time by giving written notice. If you terminate after services have commenced, you may be liable for the portion of work completed.

17. General

• Entire Agreement: These Terms constitute the entire agreement between you and Coastal Mow and Go regarding our services.
